This Privacy Policy describes how Murrin Bix Development & Marketing, Inc. dba WAYPOINT (“Waypoint”) collects, uses, and discloses your Personal Information when you visit or make a purchase from Shop Atlus (the "Site" or "we").

The Site is operated and owned by Waypoint. The ATLUS® and associated trademarks and trade dress are owned by and used under license by SEGA.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

  • Identifiers, such as name, postal address, Internet Protocol address, email address, phone number, and payment information.
  • Internet or other similar network activity, such as browsing history, search terms, and how you interact with the Site. We collect this information through the use of cookies, log files, web beacons, tags, and/or pixels. 
  • Commercial information, such as transaction information and purchase history, including purchases considered.

We collect the above categories of Personal Information directly from you.

    Minors

    The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

    Sharing Personal Information

    We share each of the above categories of Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above.     We may share each of the above categories of Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive,  and to protect our rights, privacy, safety, or property or that of our affiliates, you, or others.

    We have a legitimate interest in disclosing or transferring each of the above categories of Personal Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

      Behavioral Advertising

      We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you, as well as to analyze how the Site is used. For example:

        Using Personal Information

        We use your Personal Information to provide the Site and our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order and associated customer support, and sending administrative information to you. We engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.

        We use your Personal Information to keep you up to date on new products, services, and offers. We engage in this activity with your consent or where we have a legitimate interest.

        We use your Personal Information to accomplish our business purposes, such as to perform analytics on Site usage, to optimize the Site, for audits, and for fraud prevention and security monitoring. We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation, and/or based on our legitimate interest.

          Retention

          When you place an order through the Site, we will retain your Personal Information for our records for no longer 7 years from the time of last purchase or executed contract in order to support. Factors for determining the length of time we store Personal Information include our legal obligations, such as finance reporting and tax remission, active communication with individuals engaging with the store, and communications regarding past purchases.

          Automatic decision-making

          For individuals in the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

          We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

          Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

          Services that include elements of automated decision-making include:

          • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
          • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

          Selling Personal Information

          We do not sell Personal Information (including the Personal Information of minors under age 16), as “sell” is defined under the California Consumer Privacy Act (“CCPA”). 

            Your rights

            GDPR

            Individuals who are in the EEA have the right to access the Personal Information we hold about them, to port it to a new service, and to ask that the Personal Information be corrected, updated, or erased.   If you would like to exercise these rights, please contact us using the email below.

            You have the right to lodge a complaint with an EU/EEA data protection authority for your country or region where you have your habitual residence or place of work or where an alleged infringement of applicable data protection law occurs.

            Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. Shopify protects personal data according to the requirements of the GDPR as it is transferred to and processed in the United States and Canada.

            Shopify has set up its data flows to take care of these requirements for merchants. As described in Section 12 of Shopify's Privacy Policy, all European personal data is initially received from merchants and processed in Ireland by Shopify's Irish affiliate Shopify International Ltd. Shopify then transfers that data onward in compliance with the GDPR: Shopify encrypts data sent to and from merchants and customers using the HTTPS protocol. Shopify also encrypts any sensitive stored information, and salts and hashes merchant and customer passwords using bcrypt.

            CCPA

            If you are a resident of California, you have the right to request the categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information, the specific pieces of Personal Information we hold about you (including in a portable format), the business or commercial purposes for collecting Personal Information about you, and the categories of Personal Information about you that we shared and the categories of third parties with whom we shared such Personal Information (also known as the ‘Right to Know’). You also have the right to ask that Personal Information we have collected from you be deleted (the ‘Right to Delete’). If you would like to exercise these rights, please contact us through the contact information below. We may need to request additional Personal Information from you in order to verify your identity and protect against fraudulent requests. California residents have the right to be free from unlawful discrimination for exercising their rights.

As part of our verification process, we may request that you provide, as applicable, proof concerning your status as an authorized agent, which also may include:

              • Proof of your registration with the California Secretary of State to conduct business in California;
              • Proof of a power of attorney from the resident pursuant to Probate Code sections 4121-4130.

            If you are an authorized agent and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4121-4130, we may also require the resident to:

              • Verify the resident’s own identity directly with us; or
              • Directly confirm with us that the resident provided you permission to make the request.

            The conversion on each currency is just an approximation not the exact price you will pay, that depends on your bank and time of purchase.

            Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

            We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
